12.02.2011: International communications are a privacy-free zone

Die Auseinandersetzung in den USA über das Abhören von Telefonen ist eigentlich ein Erbe aus dem Krieg gegen den Terror von der Bush-Regierung. Nun stellt sich heraus, dass die Obama-Regierung genau diese umstrittenste Taktik fortsetzt, in dem pauschal exekutive Befugnisse geltend gemacht werden
So hat jetzt, 30 Jahre später, das FBI sich alte Bestimmung aus dem "1978 federal wiretapping law" wieder angeschaut und entschieden, dass es keine Einschränkungen für Aufzeichnungen im Zusammenhang mit internationaler oder ausländischer Kommunikation gebe. Damit wird die internationale Kommunikation in eine Datenschutz-freie Zone ohne rechtliche Verfahren verlegt. Diese Auslegung könnte auch für E-Mails gelten, auch wenn es diese damals noch nicht gegeben habe.

"Now, 30 years later, the FBI has looked at this provision again and decided that it is an enormous loophole that allows them to ask for, and the phone companies to hand over, records related to international or foreign communications," he said. "Apparently, they've decided that this provision means that your international communications are a privacy-free zone and that they can get records of those communications without any legal process."

That interpretation could be stretched to apply to e-mails as well, he said.
