TTIP: the Walled Democracy - Stop TTIP (& CETA) ! Sign Now!

After successfully spending our time with ACTA in the past, TTIP has now left us in shock . We didn’t expect a second try that fast. The time has come  for us to show the potential that we have used in the past again.

That’s why we want to try to show the content of TTIP and the differences to ACTA. That is quite hard as the Negotiations take place behind closed doors. Some of the points of the following list still have to be edited. That ist the reason for so many uptdates, the "normal" content starts here.

Update 24.08.2015: Slowakei erreicht EBI-Quorum und 2,5 Millionen Unterschriften erreicht!
Yet another good news. We didn't just surpass the 2.5 million mark this week, we've also reached another country quorum: Congratulation to Slovakia!!! Now, who's going to be the 20th country to make it? Romania and Portugal are both next in line with 62%.

Update 02.06.2015: Special Complaints Rights for Groups due to the SPD?
If the Investor Protection (ISDS) would come into TTIP then groups would have the possibility to take legal actions against political decisions in front of international arbitration boards. The SPD has promised to not say yes to any agreement that includes ISDS. A lot of  SPD Representatives have said to be against ISDS. But exactly at this point the Social Democrats could make the Investor Protection become a part of TTIP: Currently the European Parliament is looking for a solution for TTIP. If the Parliament clearly declines ISDS in it then the Investor Protection and TTIP would be sitting on a fence. But instead of voting against ISDS, the SPD Representatives on the commercial committee, have now voted for it.

Update 01.06.2015: “Free Trading” is forbidding Open Source.

Update 04.02.2015: Greece is going to use it’s right of veto to block the suggested trade agreement- if it continues to exist as it is, says Georgios Katrougkalos, Vice-head of the Ministry of the Interior.

Update 03.12.2014: After just two months we were able to gather the first million of signatures for the self-organised European local initiative against the free trade agreement TTIP and CETA. One of the many Successes of this Campaign.

However the SPD Chief Sigmar Gabriel has made himself massively stronger with the trading agreement CETA with Canada. With this he is doing exactly the opposite of what he said two months ago and is ignoring the decisions of his own party.

Update 25.09.14: On the 11th October European wide march on the streets against TTIP and CETA and against the democracy-hostile decision of the EU, to forbid a European Citizen Initiative (EBI) against TTIP.

Update 2.9.14: With the planned EU-Canada agreement CETA is threatens TTIP out of the picture. After five years of secret meetings the Tagesschau has finally released the text. It shows that in the future multinational groups will be able to take legal action in front of private arbitration boards concerning Fracking bans, consumer protection rules and the minimum income rights. In this process the groups Lawyer companies will represent Judge, Prosecutor and Defendant. An appeal will not be possible. Already in three weeks the Federal Government could be able to give the Okay in a EU-Canada conference. However the SPD isn’t completely sure- and dreads the public debate: Sigmar Gabriel has rejected our inquiry to get the first 250.000 votes against the CETA and to discuss them with us. It is said that he has time management problems- a rather weak excuse.
We are not going to give up that easily. Already on Friday we want to try it again but this time backed up with 350.000 signatures. If we don’t get an appointment then, we will put Gabriel on the spot at the SPD Convention on the 20. September and give him the signatures. Help us now to collect the missing 100.000 signatures:

Arbitration Boards should judge over States and their Social standards.

The trading and investing agreement TTIP between the USA and the EU should bring, as promised by the EU Commission and Trade associations, growth and more workplaces.

But critics are scared that in the long term the TTIP  basic democracy will end the social and ecologic standards. Even if the EU commission says otherwise, not only will GM technic, hormone meat and dangerous chemicals find their way into Europe but also due to being afraid of expensive group complaints, the TTIP could block an advanced environmental and social legislation on both sides of the Atlantic. This is because the, in the agreement planned, Investor's state arbitration proceedings (ISDS) permit Enterprises to sue Government, in front of extrajudicial tribunals, for escaped profit.

ISDS arbitral procedures- that are already included in the agreement- already undermine the state of law today, says the social judge Jürgen Borchert.
Vattenfall sued the Government in a secret court for 4 billion Euro because of stopping the use of nuclear power. Other Companies sued Egypt for the introduction of minimum wage and Canada because of a moratorium against Fracking.

In addition the Canadian-European agreement CETA, which like TTIP is discussed about under strict secrecy, also includes some of the same accusations. Not only the arbitration proceedings but also TTIP and CETA in their whole concept are not quite agreeing with the democratic principle, says the European delegate Sven Giegold. With those trade agreements the democracy, in the long term, would walled themselves in and higher social and environmental standards would then not be possible anymore.

Dominance over the 3rd world and push back Chinas influence.

Against the layout of the world economy the west now wants to gear up with new initiatives. A economic-NATO, or how the TTIP free trade agreement between USA and the EU is also called, should provide for a stronger economic  fusion by concurrent containment of the rise of the railroad engines of the south. Sven Hilbig is currently investigating TTIPS possible results on developing countries.

His result: “The attempt of the EU and the USA to push their trading rules onto the rest of the world using TTIP is, in the case of the European, a 500 year old tradition… TTIP is maybe the last exertion of the Europeans and US- Americans to keep a dominant role in the world politics against a more powerful growing world in which China and multiple other Regional Powers are demanding more global say.” If they are going to be successful is more than questionable as there is a wide and already quite successful movement growing against this impertinent attack on social and ecological standards. 

So Verdi demands that:” Social and ecological aims must be pursued with equal standing to the economic goals. That means: Adaptation of environmental regulations and standards, in each case to the highest level, also an entire ratification of all ILO social standards in the EU as it has happened in the USA, protection of the rights of codetermination and employee’s rights in trans-Atlantic enterprises on the highest standard…”

In this connection you can see just how many ILO norms to the labour rights were not ratified by the USAs practice of  “Hire and Fire”- and are not more often kept in Europe. This is a wide field for common mobilisation for both sides of the Atlantic.

Petition against TTIP

Our action Freedom instead of Fear inc. is with over 450 other NGOs in Europe a supporter of SEBI, the self-organised citizen’s group against TTIP. It already has 1.9 million people signed on and would now be valid following the EUs legislations.

How is it going with NAFTA? Has the agreement worked as promised?

Full economic growth and countless new jobs- with this the Government are winning over the trans-Atlantic free trade arrangement TTIP. However the promise is not to be trusted completely, as the experiences of the free trade agreement NAFTA  which exists since 1994 between Mexico, Canada and the USA show.

Already back then the advocates advertised violently for the North American agreement and promised growth, jobs and a better quality of life. However nothing of it has become true: More jobs have been lost then created, inequality has risen, wages were shrinking and the investment protection was used by groups to attack decisions of the environments protection in front of arbitration boards.

Representatives of the American association of labour unions report which promises of fears have been proves to be true 2o years after NAFTA. Their answer is crystal clear: NAFTA has failed.

Die Klagewelle vor den ominösen Schiedsgerichten rollt schon an. Monsanto und Exxon verklagen europäische Staaten auf Milliardensummen, weil diese Gen-Food oder Fracking verbieten – dieser Albtraum droht uns mit dem TTIP-Abkommen zwischen den USA und der EU.

Aber während die Verhandlungen dazu andauern, haben die EU und Kanada ein anderes Investitions- und Handelsabkommen schon ausgehandelt: CETA. Mit ihm kommt TTIP durch die Hintertür. Konzerne müssten nur eine Tochterfirma in Kanada eröffnen – und könnten mit CETA Deutschland vor konzernnahen Schiedsgerichten verklagen, sobald ein Gesetz ihre Gewinne schmälert.

Laut Süddeutscher Zeitung hatten deutsche Diplomaten betont, dass die Bundesregierung CETA „so, wie es jetzt verhandelt ist“, nicht unterzeichnen könne. Dann ließ Gabriel dies dementieren, alles sei weiter völlig offen. Jetzt wollen wir klar stellen: Wenn er CETA zustimmt, löst er eine ebenso große Protestwelle aus wie gegen TTIP. Wir möchten nicht, dass Konzerne vor privaten Schiedsgerichten über demokratische Gesetze befinden.

Dem ARD-Hauptstadtstudio liegt der etwa 1500 Seiten umfassende CETA-Vertragstext vor. Im Windschatten der öffentlichen Aufmerksamkeit um das Transatlantische Freihandelsabkommens TTIP zwischen der EU und den USA und das plurilaterale Abkommen zum Handel mit Dienstleistungen (TISA) steht das europäisch-kanadische
Wirtschafts- und Handelsabkommen (CETA) kurz vor dem Abschluss. Nun zeigt der geleakte Vertragstext, dass auch das CETA, das als Blaupause für das Freihandelsabkommen TTIP gilt, nationale Regierungen den Klagen privater Investoren aussetzt.

Die sogenannten Investor-Staat-Schiedsstellen (ISDS) ermöglichen es Konzernen, Staaten vor geheimen Schiedsgerichten zu verklagen, wenn sie der Auffassung sind, dass ihre Investitionen durch Gesetze und Maßnahmen der Regierung beeinträchtigt oder ihre Gewinne geschmälert werden. Auch das CETA-Abkommen eröffnet eine Paralleljustiz für
Konzerne, deren Entscheidungen über den Urteilen ordentlicher Gerichte stehen. Konzerne könnten so Schadensersatzforderungen in exorbitanter Höhe zu Lasten der Allgemeinheit geltend machen.

Nach sechs Jahren sind die Verhandlungen über das europäisch-kanadische Handelsabkommen CETA zu Ende. Die EU-Kommission hat sich mit ihren Vorstellungen von weitgehenden Investitionsschutzklauseln durchgesetzt. Kanadische Konzerne könnten so die EU, ihre Mitgliedsstaaten und Bundesländer auf Schadensersatz verklagen, wenn demokratische Gesetzesänderungen, rechtsstaatliches Handeln von Behörden oder Gerichtsentscheide ihre Gewinne schmälern. Auch kanadische Tochterfirmen US-amerikanischer oder sogar europäischer Konzerne könnten diese Klauseln nutzen.

CETA würde ein Verbot von Fracking oder schmutzigen Bergbaupraktiken in Europa erschweren und in Kanada Medikamente teurer machen. Noch ist das Abkommen nicht ratifiziert. Damit es in Kraft tritt, müssen das Europäische Parlament, das kanadische Bundesparlament und die Parlamente der 28 Mitgliedsstaaten der EU zustimmen. Lehnt nur ein einziges Parlament davon den Vertrag ab, ist CETA Geschichte.

TTIP bedroht auch unser friedliches Zusammenleben in Europa. Damit soll ein Keil zwischen der EU und anderen Ländern in Europa getrieben werden. IMI schreibt dazu:

Vollkommen zu Recht ist die „Transatlantische Handels- und Investitionspartnerschaft“ (TTIP) in jüngster Zeit immer stärker in die Kritik geraten. Während dabei bislang in der Debatte vor allem soziale und ökologische Fragen im Zentrum der Kritik stehen, beschäftigt sich diese Studie mit den geopolitischen Aspekten des Abkommens, die es auch aus friedenspolitischer Sicht ebenfalls hochgradig problematisch machen. Die Untersuchung des Transatlantischen Elitendiskurses um das TTIP ergibt, dass sich beide Seiten in fünf Bereichen hiervon einen militärisch-machtpolitischen Mehrwert versprechen. Erstens geht es ganz grundsätzlich um die Neuformierung und Stärkung des westlichen Machtblocks gegen Rivalen wie China oder Russland. Dieser westliche Block erhofft sich mit dem TTIP zweitens, neoliberale globale Standards zu setzen und zu stärken, um so das eigene Ordnungsmodell gegenüber dem angeblich grassierenden „Staatskapitalismus“ besser in Stellung zu bringen. Als dritter Aspekt soll der Ausbau der transatlantischen Energiekooperation vor allem die Abhängigkeit der Europäischen Union von Russland reduzieren und so den Weg für eine noch konfrontativere Politik frei machen. Und schließlich soll das Abkommen eine Vertiefung der transatlantischen Rüstungskooperation und einen europäischen Rüstungsschub bewirken. All diese Auswirkungen des Abkommens fördern die ohnehin schon gefährlichen Tendenzen zu einer weiteren Blockbildung im internationalen System und leisten einer weiteren Militarisierung im Westen Vorschub. En réponse a la Commission européenne , plus de 200 mouvements citoyens, issus de 21 pays différents, ont décidé d’organiser une « ICE auto-organisée » contre TAFTA et CETA. Cette initiative connaît un succès fulgurant : lancée il y a à peine plus d’un mois, elle vient déjà de dépasser le million de signatures !

Mais, à ce jour, seules l’Allemagne, l’Autriche, la Grande-Bretagne, la Finlande et la Slovénie ont franchi le seuil de signataires, qui pourront ainsi être « *officiellement* » comptabilisés dans l’ICE.

En France, il manque 16 000 signatures pour atteindre les 55 500 attendues avant le 9 décembre, jour des 60 ans de Jean-Claude Juncker, nouveau Président de la Commission européenne et ex-dirigeant du plus grand paradis fiscal de l’Union européenne, le Luxembourg.

Regeln gegen die nächste Finanzkrise. Datenschutzvorgaben für Konzerne. Rückkauf von Stromnetzen.-All das wird unmöglich mit dem geplanten Dienstleistungsabkommen TISA, dem großen Bruder von TTIP.

Auf höchster Geheimhaltungsstufe verhandelt die EU mit den USA und 21 weiteren Staaten das Trade in Services Agreement. Das Ziel: Den Dienstleistungssektor deregulieren und Privatisierungen in großem Stil ermöglichen. Besonders heikel: In Zukunft sollen Konzerne auch mit der öffentlichen Daseinsvorsorge-also mit Bildung, Gesundheit und Wasser Kasse machen dürfen.

Was einmal privatisiert ist, darf dann nie mehr öffentlich organisiert werden-egal ob Wasserversorgung, öffentlicher Nahverkehr oder Stadtwerke. Neue Maßnahmen zur Marktregulierung, etwa zur Vermeidung neue Finanzkrisen, werden verboten. Auch Regeln für die Weitergabe oder Speicherung unserer Daten wären passé. Damit droht die Demokratie außer Dienst gestellt zu werden.

Nun hat sich die FDP endgütlig von den Wählern verabschiedet. Sie ist uneingeschränkt für TTIP - das soll "freie Marktwirtschaft" sein, hat sie am 6. Januar festgestellt. Tolle Freiheit, wenn 3 unbekannte Wirtschaftsanwälte hinter verschlossenen Türen einen Staat zu Strafzahlungen verurteilen und dies von keinem Gericht der Welt untersucht werden darf! Vattenfall führt uns das gerade mit der Millionenklage wegen des Atomausstiegs vor Augen. Nicht mehr das demokratisch gewählte Parlament hat zu entscheiden sondern das große Geld.

FDP - Nein danke! Wer so etwas will, ist ein Gegner von Grundgesetz und Demokratie!

TTIP soll einen lang gehegten Traum von Lobbyisten wahr machen. Sie sollen das verbriefte Recht bekommen, mit an Gesetzen zu schreiben. Schon heute verhandeln Kommission und US-Regierung über den Vorschlag zur "Regulatorischen Kooperation".

Schon lange versuchen die großen Industrieverbände beiderseits des Atlantiks - Business Europe und American Chamber of Commerce - die Regeln für unser Leben nach ihrem Geschmack zu formen. Demokratie ist da hinderlich. Aber jetzt scheinen sie einen Weg gefunden zu haben: TTIP. Ein völkerrechtlicher Vertrag zwischen den USA und der EU, der mehr Gewicht bekommen könnte als Verfassung und Grundrechtecharta.

Laut dem Vorschlag sollen EU-Gesetze künftig zunächst von Konzernen und US-Regierung geprüft werden. Was schädlich für den Handel erscheint, was den Interessen der Konzerne zuwider läuft, verschwindet so womöglich in der Schublade, bevor gewählte Abgeordnete und Regierungen davon auch nur erfahren.
