This conference will examine the current state of fundamental rights protection within the EU and the implications of the Lisbon Treaty.
There is a multitude of legal sources that ensure the protection of fundamental rights within the EU. One is general principles of law, developed from the case law of the Court of Justice of the European Union. An important source for developing these general principles has been the European Convention on Human Rights and the Charter of Fundamental Rights that was “solemnly proclaimed” in 2000.
Through the entry into force of the Lisbon Treaty, the Charter will become legally binding on the EU and its Member States. A further development that will become possible through the Lisbon Treaty is the Union's accession to the European Convention on Human Rights. What do these changes mean for the protection of fundamental rights in the EU? How will those legal sources interact in the framework of the EU? What importance do the opt-outs of some Member States have? Moreover, what will the relationship between the Court of Justice of the European Union in Luxembourg and the European Court of Human Rights in Strasbourg look like in the future?
Target groups are primarily: national government officials, EU officials, lawyers
and national judges
